These terms and conditions apply to your use of the website www.coolmed.co.uk and every order placed with CoolMed Ltd. We are committed to providing an exceptional service to our customers, therefore – prior to placing an order with us – please read the following terms and conditions applying to your order and ensure that you are happy with them.
Our contract with you
When you place an order with us, you agree to purchase the product(s). After placing the order, an order acknowledgement will be sent to the email address you have provided. The order will only be accepted once the product(s) are ready for despatch, which is when the contract between CoolMed and you becomes legally binding. Until this time, we reserve the right not to fulfil your order for any reason, such as pricing, listing or stock error. In the event of such circumstances, the order will be fully refunded.
Availability
Wherever possible, we display the latest stock availability on our website. However, errors can occasionally occur. In such circumstances, we will endeavour to contact you as soon as possible, in order to resolve the situation.
Website information
All our images, descriptions, specifications and advertising are correct at the time the information is received from the manufacturer with regard to product dimensions. Please note that these do not include any protruding features. Dimensions depict the measurements of the main body of the appliance only. Whilst we try to be as accurate as possible, all dimensions and weights are approximate and should be considered as a guide only.
With regard to colours and images, we make every effort to correctly represent our products. However, there may be slight differences in colour due to changes in manufacturing processes.
Any customer reviews of the products sold on our website are solely the opinions of those customers and do not form any part of the appliance specification. We are not liable if any information given in reviews is incorrect.
You, the customer, acknowledge and agree the following:
- The copyright of the photos, text or any other content used on the website belongs to CoolMed. In addition, the overall look and feel of the website belongs to CoolMed. Material from our website may not be used without written authorisation from CoolMed Ltd.
- CoolMed reserves the right to change and/or amend the website and any information contained within without prior notice. Please note that the terms and conditions applicable at the time of your order will still apply to the purchased product.
Prices
All prices displayed include VAT, but exclude other services, such as delivery.
CoolMed may occasionally offer products at discounted or promotional prices. Any such offers will only apply to selected products and are subject to availability. They may also be withdrawn at any time at our discretion. Delivery charges, conditions and geographical exclusions may apply.
Payment
We accept all major credit and debit cards for payment through our website, including PayPal payments. All transactions are protected by SSL (Secure Socket Layer) encryption to ensure that your details remain secure.
Returns and cancellations
If you change your mind after placing an order, you can cancel at any time before the product is despatched, regardless of the reason, without incurring any cancellation charges. If you are not entirely happy with the product, you can return it to us within 30 days of the purchase date.
Please note that we require the returned product to be returned in good condition, ie. undamaged, with all contents and with the original, undamaged packaging.
If you wish to return a product, please contact us by email on info@coolmed.co.uk, or call us on +44 161 772 5666, so that we can provide you with the correct return address.
Once the return of the product has been confirmed with us, the return must be completed within 14 days. If it arrives any later, CoolMed will be unable to issue a refund. In order to speed up the identification of your return, we require your full details and order number to be clearly highlighted on the outside of the packaging, in such a way that it does not damage either the packaging or the product. Products returned without such identification will take longer to process and the refund may be delayed. You have a statutory duty to take care of the returned goods – any damage caused may void your right to return the product. You are responsible for the cost of returning the product to CoolMed.
We recommend that the product should be inspected prior to return and despatched by a recorded method of delivery, as proof of return may be required. It should also be insured in case of damage during return transit.
If you do not use insurance and the product is damaged or lost in transit back to CoolMed, you are fully liable for the cost of the product. If insured, you will be able to claim reimbursement through your carrier. Provided that the product is received in perfect re-saleable condition and in its original packaging, CoolMed will be able to issue a refund.
Please note that if any items are missing from the returned product (shelves, manual, keys etc), then you will no longer be eligible for a refund.
Missing, damaged or incorrect orders
It is extremely important that your order is checked on delivery. Almost all our orders arrive with our customers in perfect condition and on time. However, if any damage is noted at the time of delivery, the product can be refused and returned with the driver.
In the unlikely event that your order is incomplete, please contact us immediately, so that we can confirm delivery status of the missing items. Similarly, if you have received an incorrect item, please contact us as soon as possible for a quick and efficient resolution of your problem. For large products which require a 2-man delivery, the delivery personnel will help you with the product and wait while you check it. Please take advantage of this, so that any defects can be reported immediately and the product removed and replaced as soon as possible.
We understand that you may not wish to open and test your product as soon as it arrives, but it is very important that you report any issues urgently, preferably on the day of delivery. However, if this isn’t possible, we consider it reasonable for you to check it within 3 days of delivery. We are unable to accept any damage reported after 14 days after purchase date.
To report damage on delivery, please email CoolMed on info@coolmed.co.uk, stating your order number, purchase date and full name, as well as any images you may have of the damage to the product and/or packaging, so that we can deal with your problem as quickly and efficiently as possible.
Faulty products
On very rare occasions, one of our products may develop a fault. Our policy for dealing with faulty goods is intended to ensure that you get the fastest resolution possible and reduce the amount of time you are without an appliance.
The policy depends on the product type and how the fault has developed. Depending on these factors, we aim to either repair or replace the appliance. If a repair is not viable, a refund will be offered. Resolutions to such problems will be offered in line with the timelines specified by the Consumer Rights Act (2015). Nothing within these terms will affect your legal rights.
To report a fault with a product, please email CoolMed on info@coolmed.co.uk, stating your full name, date of purchase, order number, model number and a description of the problem. This will enable us to deal with your issue quickly and efficiently.
Things beyond our control
CoolMed will not accept responsibility for any failure to perform or delay in performance of any of our obligations under these terms, caused by events outside our reasonable control. Such events are defined as any act, non-occurrence, omission or accident beyond our reasonable control, including the following:
- Strikes, lock-outs or other industrial action
- Civil disturbance, riot, invasion, terrorist attack (or threat thereof), war (declared or not), threat or preparation for war
- Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster (including adverse weather)
- Impossibility of use of railways, shipping, aircraft, motor transport, including road closures and traffic congestion
- Impossibility of use of telecommunications network (public or private)
Our obligations under these terms are suspended for the period within which the event continues and we claim an extension of time in such circumstances to perform these obligations. We will take all reasonable steps to find a solution whereby our obligations can be met despite the event.
General
The contract between CoolMed and you, the customer and the rights and obligations of both parties shall be governed by English law and any disputes arising under it shall be heard in the English courts.
